Division of Assets in North Carolina

Vehicles, such as cars and boats, are going to be split like all other marital assets. North Carolina divorce cases follow equitable distribution laws, which are comprised of four parts:

  • Identification — The court must first identify all assets and any debts that might be attached to them that are shared within a marriage. It does not matter when or how the assets or debt was acquired during the identification process.
  • Classification — Once identified, assets are classified in one of three ways. 1) The first is separate property, which is considered anything that is owned by either spouse at any time — before the marriage, during the marriage, and after the date of separation. There are also considerations for other property, such as inheritance and other gifts that were given to only to one spouse; 2) The second classification is for marital property, which includes assets and debts that were acquired by both spouses during the marriage, ending on the date of separation, including cars and other vehicles that are in both spouses’ names and gifts from spouse to spouse; 3) The third classification is for divisible assets — those that were acquired after the date of separation.
  • Valuation — After classification, assets and their debts are assigned a monetary value so that all assets can be equally distributed at the end of the process. This is the step in which a lawyer can help you the most by ensuring accurate valuations for property that will help you secure a fair settlement in the final step of asset division.
  • Equitable Distribution — Equitable distribution ensures that both parties receive an equal settlement after a divorce. An unequal division of assets is rarely granted by the court.
